Terms of Service

1. Agreement

By creating an account, using an API key, submitting a URL, calling an endpoint, or otherwise using TomsIndex, you agree to these Terms. If you use TomsIndex for an organization, you represent that you are authorized to bind that organization.

2. Accounts and API keys

You are responsible for your account, credentials, API keys, and all activity under them. Keep API keys confidential, use reasonable security controls, and notify us if you believe a key has been compromised. We may rate-limit, suspend, revoke, or refuse service to protect TomsIndex, other users, or third parties.

3. Data and privacy

We store your account details (name, email, hashed password), API key prefixes and hashes, and the pages you extract — URL, title and markdown — in your account's private index. Other accounts cannot list or read your index. Extracts from the homepage demo, and API calls with "save": false, are not saved to an index. Long keyless MCP results are held in memory for up to one hour so your agent can page through them, then discarded. Pages that need JavaScript are rendered by a headless browser on our own server. GitHub, npm, PyPI and Stack Exchange URLs are read through those services' public APIs.

We keep standard request logs (URL requested, time, IP address, errors) to operate the service, debug failures and prevent abuse. We do not sell your data or use your index to train models.

The website uses Google Analytics to count page views. It does not run on API or MCP requests.

Do not submit secrets, regulated personal data, private content, or confidential third-party information unless you have the rights and authority to do so.

4. Content and permissions

You retain ownership of content you submit. You grant TomsIndex a non-exclusive, royalty-free license to fetch, process, store and return the pages and content you submit, only as needed to provide the service to you.

You represent that you have the rights needed for anything you submit, including the URLs you submit. You are responsible for the legality, accuracy, and consequences of your use of TomsIndex outputs.

5. Acceptable use

You may not use TomsIndex to break the law, violate third-party rights, bypass access controls, scrape or extract content you are not permitted to access, distribute malware, overload infrastructure, spam, evade rate limits, abuse authentication, or interfere with the service.

6. Third-party content and outputs

Extracted pages, links and metadata come from third-party websites and may be incomplete, outdated, inaccurate, unavailable, or subject to those sites' rights and terms. You are responsible for having the right to fetch and use the pages you extract.

7. Fees and plans

TomsIndex is currently free, with rate limits. If we introduce paid plans, we will announce them in advance and they will apply only going forward.

8. No warranties

TomsIndex is provided "as is" and "as available." We do not promise that the service will be uninterrupted, secure, error-free, accurate, complete, or fit for a particular purpose.

9. Limitation of liability

To the maximum extent permitted by law, TomsIndex and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, or loss of goodwill.

To the maximum extent permitted by law, our total liability for any claim relating to TomsIndex will not exceed the amount you paid to TomsIndex for the service giving rise to the claim during the three months before the event giving rise to liability, or $100 if you paid nothing.

10. Indemnity

You agree to defend, indemnify, and hold TomsIndex and its operators harmless from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from your use of the service, your content, your violation of these Terms, or your violation of law or third-party rights.

11. Changes and termination

We may update these Terms from time to time. Continued use after an update means you accept the updated Terms. We may suspend or terminate access at any time, including for abuse, legal risk, security concerns, or violation of these Terms.
